Informed Consent and Acknowledgement

 

I assume all risks and hazards incidental to the conduct of the activities and release, absolve, and hold harmless West K Hoops, in addition to all its respective officers, agents, and representatives, from any and all liability for injuries to said child arising out of travelling to, participating in, or returning from a selected camp or program session.

All sports, including basketball, carry an inherent risk of injury. Some of these injuries include, but are not limited to, the risk of lower body injuries such as ankles and knees, muscle and tendon sprains and pulls, and upper body injuries such as hands, fingers, head, face, teeth, and eye injuries. Other sports-related injuries include muscle bruising, fractures, concussions, fatigue, exhaustion, dehydration, paralysis, and death. In the event of said child's injury, I hereby waive all claims against West K Hoops, including all coaches and affiliates, all participants, sponsoring agencies, advertisers, and, if applicable, owners and lessors of the premises utilized to host the event.

I hereby give my approval for my child’s participation in any and all activities prepared by West K Hoops during the selected camp or program. In exchange for the acceptance of said child’s candidacy by West K Hoops. I give the registered player(s) full permission to take part in any activity that West K Hoops offers. I agree that all staff of West K Hoops will not be held responsible for injury to the registered player(s) as a result of participation in any West K Hoops camp, training, or program.

Media: I understand that, under the service of West K Hoops, pictures and videos are permitted solely for the use of West K Hoops advertisements and promotional material. I consent to West Kelowna Youth Basketball Association representatives (known as "Westkhoops") interviewing, recording, photographing, video, or filming my registered child in club camps or programs for publication, display, or broadcast (print, web, digital display, and all other forms of social and marketing media) on the organization's related properties and websites. I agree that Westkhoops owns all interviews, recordings, articles, quotes, photographs, films, audio or video, and any reproductions of the same in any form, and I waive any present or future claim for reimbursement for said photographic or film reproduction of my child's likeness or for said testimonials by me or my youth attending club programs. I release Westkhoops, its affiliates, employees, coaches, representatives, and agents from any and all claims, demands, costs, and liability arising from the use of these interviews, recordings, photographs, videos, or films, and/or any reproductions of the same in any form, as described above. I confirm that I have read or been read (or translated) this permission consent and had the chance to ask questions and understand it.

I understand that my personal and my youth's personal information, including images of my youth, is being collected pursuant to Section 26 of the Freedom of Information and Protection of Privacy Act, R.S.B.C. 1996, c. 165. Refund Policy: By acknowledging and accepting the Terms and Conditions, participants indicate their agreement to Westkhoops' refund policy. If a camp or program has not yet commenced and a request for a refund is made at least 10 days before the starting date, a full refund can be granted. Cancellations made nine days or less before the start date may be eligible for a 50% refund. Once a camp or program session has begun and the participant has attended or not attended, no refunds will be issued. The remaining 50% of the payment is non-refundable as it covers administration fees, the loss of holding a spot, and coaching staff expenses that were planned based on the number of registered participants. In the case of a medical absence or injury, refunds or credit will only be provided upon presentation of a physician's note. Refunds will not be given in the event of an "Act of God" or a crisis affecting the global, national, or local level.

The camp directors reserve the right to dismiss and exclude anyone from the camp/programs for an improper attitude, action, disturbance, or disobedience to camp rules. If a participant (player) is dismissed from the camp or program, there will be no refund. No refunds will be given after one year from the payment date towards any program or camp. A $40.00 fee will be charged for returned/bounced checks given to the organization.

Receipt: A copy of your payment receipts for programs and camps is provided automatically after submitting the online camp checkout and registration process. In case of an electronic error, an additional copy of the payment receipt is available upon request via email or phone call.

Parent/Guardian Agreement

By signing and checking the terms and conditions box at online checkout, parents and guardians agree to the drop-off and pick-up times and rules of the school or gym facility during March Spring Break and Summer Camps. Parents and guardians are asked to leave school premises once the camps or programs begin after dropping their child or player(s) off. They also must respect the pick-up and entry times of the school, gymnasium, camps, and programs. The club's drop-off and pick-up times depend on those specific school or rental facility hours and policies. The specific time of camp drop-off and pick-up will be outlined in precamp information issued by the club (unless a different time has been prearranged with the coaching staff and communicated to parents and guardians). Failure to follow these terms can result in a player or players being dismissed from the camp or program with no refund.  This rule can only be excused if there has been an agreement between the directors or coaching staff of the camps or programs and the parents or guardians in written form as proof.

Medical Release and Authorization

As Parent and/or Guardian of the named athlete, I hereby authorize the diagnosis and treatment by a qualified and licensed medical professional, of the minor child, in the event of a medical emergency, which in the opinion of the attending medical professional, requires immediate attention to prevent further endangerment of the minor’s life, physical disfigurement, physical impairment, or other undue pain, suffering or discomfort, if delayed.

Permission is hereby granted to the attending physician to proceed with any medical or minor surgical treatment, x-ray examination and immunizations for the named athlete. In the event of an emergency arising out of serious illness, the need for major surgery, or significant accidental injury, I understand that every attempt will be made by the attending physician to contact me in the most expeditious way possible. This authorization is granted only after a reasonable effort has been made to reach me.

Permission is also granted to the West K Hoops and its affiliates including Directors, Coaches, and Team Parents to provide the needed emergency treatment prior to the child’s admission to the medical facility.

Release authorized on the dates and/or duration of the registered season.
This release is authorized and executed of my own free will, with the sole purpose of authorizing medical treatment under emergency circumstances, for the protection of life and limb of the named minor child, in my absence.

OTHER ASSUMPTION OF RISK: You agree that if you engage in any physical exercise or activity, including personal/fitness training, or enter our premises or use any facility or equipment on our premises for any purpose, you do so at your own risk and assume the risk of any and all injury and/or damage you may suffer, whether while engaging in physical exercise or not. This includes injury or damage sustained while and/or resulting from using any premises or facility, or using any equipment, whether provided to you by Trainers/Coaches or otherwise, including injuries or damages arising out of the assistance of a Trainer/Coach, whether active or passive, or any of Trainer’s/Coaches affiliates, employees, agents, representatives, successors, and assigns.

Your assumption of risk includes, use of any exercise equipment (mechanical or otherwise), sports fields, courts, or other areas, locker rooms, sidewalks, parking lots, stairs, pools, lobby or other general areas of any facilities, or any equipment.

You assume the risk of your participation in any activity, class, program, instruction, or event, including but not limited to basketball camp/program, basketball training, weightlifting, walking, jogging, running, aerobic activities, aquatic activities or any other sporting or recreational endeavour.

You agree that you are voluntarily participating in the aforementioned activities and assume all risk of injury, illness, damage, or loss to you or your property that might result, including, without limitation, any loss or theft of any personal property.
